FIBREGLASS POOL STRUCTURAL GUARANTEE
Pool Guarantee at a Glance
Advance Pools Fibreglass Pool Guarantee Terms
Advance Pools provides the original purchaser with a limited 15-year structural guarantee on its fibreglass swimming pool shell from the date of installation.
For purposes of this guarantee, “structurally sound” means that the fibreglass pool shell remains capable of containing and holding water under normal operating conditions when correctly installed, operated and maintained.
15 YEAR STRUCTURAL GUARANTEE
Where a pool shell suffers a qualifying manufacturing-related structural failure during the guarantee period, Advance Pools will, at its discretion, repair, reinforce, modify or replace the affected shell or portion thereof.
Water loss, cracking, deformation or movement does not, by itself, establish a manufacturing defect or a valid structural guarantee claim. The cause of the reported problem must first be determined.
INSTALLATION & WORKMANSHIP
Where a pool is installed by Advance Pools or an authorised Advance Pools installation team, installation workmanship is guaranteed for a period of 12 months from the date of installation.
Where installation is carried out by an independent installer, contractor, builder, developer or purchaser, that party remains responsible for its own workmanship and for compliance with Advance Pools’ installation specifications.
Damage caused or contributed to by incorrect, inadequate or non-compliant installation is not covered by the 15-year structural guarantee.
Where the cause of a reported failure may relate to installation, Advance Pools may require reasonable evidence regarding the installation, including installer details, photographs, backfill information, drainage arrangements and other relevant information.
GELCOAT, COLOUR & SURFACE FINISH
Gelcoat and cosmetic surface defects attributable to workmanship are covered for a period of 12 months from the date of installation.
All guarantees are expressly excluded in respect of fading, discolouration, staining, shade variation or other changes in colour resulting from UV exposure, water chemistry, chemicals, minerals, temperature or normal ageing.
Where a surface repair is undertaken, materials will be selected to approximate the original finish. However, an exact colour match cannot be guaranteed, particularly where the original surface has aged or weathered.
For the avoidance of doubt, the 15-year structural guarantee does not constitute a 15-year guarantee on the gelcoat, colour or cosmetic appearance of the pool.
EQUIPMENT & COMPONENTS
The 15-year structural guarantee does not extend to coping, paving, mosaics, plumbing, pipework, fittings, landscaping or other items external to the fibreglass shell.
Pumps, filters, motors, chlorinators, lights, heat pumps and other mechanical or electrical equipment are subject to the applicable guarantees or warranties provided by their respective manufacturers or suppliers.
INSPECTION & DETERMINATION OF CAUSE
All guarantee claims are subject to assessment by Advance Pools before liability is accepted.
Advance Pools may inspect the pool, request further information or appoint a suitably qualified person to determine the probable cause of the reported problem.
The assessment may include the manufacture of the shell, installation method, excavation, backfilling, drainage, groundwater, hydrostatic pressure, plumbing, surrounding construction, maintenance, water chemistry, operating temperature and any subsequent alterations or works.
Submitting or reviewing a claim, requesting an invoice or photographs, commenting on photographs, inspecting a pool, providing technical advice or otherwise attempting to assist a customer does not constitute acceptance of a guarantee claim, an admission of a manufacturing defect or an acceptance of liability.
MAINTENANCE & OPERATING CONDITIONS
The pool must be properly operated and maintained in accordance with Advance Pools’ installation, maintenance and operating requirements.
This guarantee does not cover damage, deterioration or failure caused or contributed to by misuse, neglect, incorrect water chemistry, excessive chemical concentrations, inadequate maintenance, algae, calcium scale, mineral deposits, unauthorised alterations or repairs.
WATER LEVEL, DRAINAGE & GROUND CONDITIONS
The pool is designed to remain filled with water under normal operating conditions and should not be emptied or allowed to remain substantially below its normal operating water level unless properly managed as part of authorised maintenance or repair work.
Appropriate drainage must be provided to prevent groundwater, stormwater or runoff from accumulating around the pool shell.
Damage caused or contributed to by groundwater, hydrostatic pressure, inadequate drainage, flooding, abnormal earth movement, earthquakes, explosions or other circumstances outside the reasonable control of Advance Pools is not covered by this guarantee.
REPAIR OR REPLACEMENT
Where a valid structural guarantee claim is accepted, Advance Pools will determine the appropriate remedial action, which may include repair, reinforcement, modification or replacement of the affected shell or portion thereof.
Unless otherwise required by applicable law, this guarantee does not include travel or accommodation costs, loss of pool use, inconvenience, replacement water, landscaping, paving, decking, fencing, access works or other consequential costs or damage.
ORIGINAL PURCHASER & GUARANTEE CERTIFICATE
This guarantee applies exclusively to the original purchaser and is non-transferable.
This guarantee is valid only where an official Advance Pools guarantee certificate, duly completed and signed by an authorised representative of Advance Pools, has been issued to the original purchaser.
The guarantee certificate will only be issued once the purchase price and all other amounts due to Advance Pools have been paid in full within the agreed payment terms.
In the event of a guarantee claim, the original purchaser may be required to provide the original guarantee certificate together with the relevant Advance Pools invoice or other proof of purchase.
GUARANTEE CLAIMS
The original purchaser must notify Advance Pools in writing within a reasonable period after becoming aware of a potential guarantee issue and provide sufficient information to allow the claim to be assessed.
Advance Pools may require:
- The original Advance Pools invoice;
- The official Advance Pools guarantee certificate;
- The installation address and installation details;
- The details of the installer;
- Photographs and/or video of the reported problem; and
- Any other information reasonably required to determine the nature and cause of the claim.
No guarantee claim will be regarded as accepted until Advance Pools has assessed the claim and confirmed acceptance in writing.
GENERAL TERMS
This guarantee is personal to the original purchaser and neither the purchaser’s rights nor Advance Pools’ obligations under this guarantee are transferable to another party.
No employee, installer, dealer, contractor or other person may vary, extend or make representations regarding this guarantee unless expressly authorised in writing by Advance Pools.
Nothing in this guarantee excludes or limits any right or remedy which cannot lawfully be excluded or limited under applicable South African law.
Operating temperature: Standard Advance Pools fibreglass pool shells are designed for water temperatures up to 29°C. Pools specifically manufactured and documented by Advance Pools to the applicable Vinyl Ester specification may be operated at temperatures up to 39°C. Damage caused or contributed to by operation above the applicable temperature is excluded from this guarantee.
Historical guarantees: These published guarantee terms apply to qualifying Advance Pools fibreglass pool shells supplied from 1 March 2021. Pools supplied before this date may have been sold subject to different guarantee periods, terms and conditions. Any guarantee applicable to an earlier pool is therefore determined by the invoice, guarantee certificate and guarantee terms applicable to that original transaction. Publication of the current guarantee terms on this website does not retrospectively extend, replace or alter the guarantee originally provided with an earlier pool.
